These Terms and Conditions (“Terms”) govern (a) your use of the website https://hornandhorizonsafaris.com/ (the “Website”), owned and operated by Horn & Horizon Safaris [Ltd] (“Horn & Horizon Safaris”, “we”, “us”, “our”), a company registered in the United Republic of Tanzania under registration number 187866014, with its principal place of business at Arusha, Tanzania; and (b) any booking you make with us for safaris, tours, trekking, transfers, accommodation or related travel services (“Services”).
Horn & Horizon Safaris is a licensed tourism operator, holding Tourism Agents Licensing Authority (TALA) licence number 032014, issued under the Tourism Act (Cap. 364, as amended). Copies of our licence and registration are available on request.
By using the Website or making a booking with us, you agree to be bound by these Terms. If you do not agree, please do not use the Website or purchase our Services. We recommend you read these Terms carefully and retain a copy for your records.
You may use the Website to browse our itineraries, request quotations, make enquiries and complete bookings for personal, non-commercial travel-planning purposes.

All content on the Website, including text, photographs, logos, itinerary designs, maps and the Horn & Horizon Safaris name and branding is owned by us or licensed to us, and is protected under the Copyright and Neighbouring Rights Act and applicable international treaties. Nothing in these Terms transfers any intellectual property rights to you.
2.4 Third-party links
The Website may contain links to third-party sites (e.g. partner lodges, airlines, park authorities). We do not control and are not responsible for the content, accuracy, or privacy practices of any linked third-party website.
2.5 Accuracy of information
We take reasonable care to ensure information on the Website, including prices, itineraries, park fees and availability, is accurate at the time of publication. However, safari pricing depends on factors outside our control (park fees, government levies, fuel costs, exchange rates), and we reserve the right to correct errors and update pricing or content at any time without prior notice. Confirmed bookings are governed by the price and itinerary stated in your written booking confirmation, not by the Website at a later date.
A booking request submitted through the Website, by email, or verbally does not constitute a confirmed booking. A booking is only confirmed once we issue a written booking confirmation and have received the required deposit referred to in clause 4.
You confirm that you are at least 18 years old and have the authority to accept these Terms on behalf of every person named in the booking (“travellers”). You are responsible for ensuring the details you provide (names as they appear on passports, dates of birth, dietary and medical information) are accurate and complete.
4.1 Currency and pricing
All prices are quoted in United States Dollars (USD) unless stated otherwise, and are per person unless indicated. Prices include the items specified in your itinerary and exclude international flights, visas, travel insurance, gratuities, and personal expenses unless otherwise stated.
4.2 Deposit
A non-refundable deposit of 50% of the total tour cost is payable at the time of booking to secure your reservation. For bookings that include scheduled flights, hot-air balloon safaris, or peak-season/migration-camp accommodation, we may require full payment at booking, as these are non-refundable to us once confirmed with the supplier.
4.3 Balance Payment The balance of the total cost is due no later than 30 days before the start date of your safari. For bookings made within 30 days of departure, full payment is due at the time of booking. Failure to pay the balance by the due date may be treated as a cancellation by you, subject to the applicable cancellation terms set out in Clause 6.

Tanzania’s national parks, weather, road conditions, and wildlife movement are unpredictable. We reserve the right to amend routes, accommodation, or the order of activities where reasonably necessary for your safety, for conservation reasons, or due to circumstances beyond our control (including park authority directives), provided we substitute services of comparable standard wherever possible and notify you as soon as practicable.
Where a significant change is made before departure that materially lowers the standard of your safari, we will offer you the choice of accepting the change, purchasing an available upgrade, or cancelling with a refund of amounts paid for the unused portion of the trip, less costs already committed to suppliers..
Cancellation requests must be made in writing (email is acceptable) to reservations@hornandhorizonsafaris.com. The following cancellation charges apply, calculated from the date we receive your written notice to the safari start date:

Costs already paid by us to third parties that are non-refundable (e.g. scheduled flights, hot-air balloon safaris, park permits, migration-camp deposits) will be deducted in full regardless of the notice period given.
6.2 Cancellation by us
We reserve the right to cancel a booking before departure in circumstances of force majeure (see Clause 8), where minimum group numbers are not met for a scheduled group departure, or where full payment is not received by the due date.
Where we cancel a booking for reasons other than your default or force majeure, you will receive a full refund of all amounts paid to us, or, where available and agreed by you, the option to transfer to an alternative departure date or itinerary.
6.3 Amendments
Requests to change confirmed travel dates, itineraries, or traveller names may be accommodated where possible, subject to supplier availability and any additional costs charged by our suppliers.
Comprehensive travel insurance is mandatory for all travellers booking with Horn & Horizon Safaris. Your policy must, at minimum, cover trip cancellation and curtailment, emergency medical treatment and evacuation (including air evacuation from remote parks), repatriation, and loss of baggage and personal effects. You must provide us with your insurer’s name and emergency contact number, and a policy summary, before departure. We are not liable for any costs, losses, or expenses that adequate travel insurance would have covered.
We shall not be liable for any failure or delay in performing our obligations, nor for any loss, damage, additional expense, or change to your itinerary, arising from circumstances beyond our reasonable control, including but not limited to: war, civil unrest, terrorism, riots; government action, border or park closures, changes in entry/visa requirements; pandemic, epidemic, or public health emergency; natural disaster, extreme weather, flooding, or fire; strikes or industrial action by third parties; and failure of transport, airline, or other supplier services beyond our control.
In such circumstances, we will use reasonable efforts to minimise disruption and, where possible, offer alternative arrangements, but any additional costs arising from a force majeure event will be your responsibility, subject to your travel insurance.
9.1 Fitness to travel
You must inform us in writing at the time of booking of any medical condition, disability, or dietary requirement that may affect your ability to safely undertake the activities in your itinerary. Certain activities (mountain trekking, walking safaris, hot-air ballooning, water-based activities) require a reasonable level of fitness and may not be suitable for all travellers.
9.2 Inherent risk of safari travel
You acknowledge that safaris and related activities take place in remote natural environments involving wild animals, unpaved roads, light-aircraft transfers, and variable weather, and that these activities carry an inherent degree of risk that cannot be entirely eliminated even where we and our guides exercise all reasonable care and follow recognised safety and wildlife-viewing protocols. You voluntarily accept these risks as a condition of travel.
9.3 Guide authority
For the safety of all travellers, our guides and drivers have the authority to alter, restrict, or terminate any activity, or require a traveller to be removed from an activity or vehicle, where they reasonably believe this is necessary for safety.
We will perform our obligations to you with reasonable skill and care. Subject to applicable law, we do not exclude or limit liability for death or personal injury caused by our negligence, or for fraud.
Where Services are provided by independent third parties (airlines, lodges, camps, park authorities, ground handlers, restaurants), our responsibility is limited to selecting such suppliers with reasonable care; we are not liable for their acts, omissions, or the standard of services they provide, except where required by Tanzanian law.
In relation to your personal property, we are not liable for loss of, or damage to, luggage or personal belongings while in our care, except where such loss or damage results from our, or our employees’, negligence or wilful default, or where the property was formally deposited with us for safekeeping and a receipt issued, consistent with the limitations applicable to tourism operators under Tanzanian law. Guests are advised to keep valuables in hand luggage and to insure personal property.
To the fullest extent permitted by law, our total liability to you in connection with any booking is limited to the total amount you paid to us for that booking.
It is your responsibility to ensure that you and all travellers in your party hold a passport valid for at least six months beyond your return date, and any visas, permits, or vaccination certificates (e.g. yellow fever, where applicable) required for entry into Tanzania and any other country on your itinerary. We can provide general guidance, but entry requirements change and the final responsibility rests with you. We are not liable for any cost or loss arising from your failure to hold the correct travel documentation.
We reserve the right, without refund, to remove or refuse to continue services to any traveller whose behaviour is, in the reasonable opinion of our staff or guides, disruptive, dangerous, illegal, or likely to cause distress, damage, or danger to other travellers, staff, wildlife, or property.
If you have a concern during your safari, please raise it immediately with your guide or our local representative so we can attempt to resolve it in real time. If unresolved, please submit a written complaint to info@hornandhorizonsafaris.com within 30 days of the end of your trip. We aim to acknowledge complaints within 6 business days and resolve them as promptly as possible.
We collect personal information (including passport details, dietary and medical information, and payment details) solely to plan, book, and deliver your safari, and to comply with park authority and immigration requirements. We process this information in accordance with Tanzania’s Personal Data Protection Act, 2022, and do not sell your personal data to third parties. Information is shared only with suppliers directly involved in delivering your trip (e.g. lodges, park authorities, airlines) and, where relevant, with your travel insurer.
These Terms are governed by the laws of the United Republic of Tanzania. In the event of a dispute, the parties agree to first attempt to resolve the matter through good-faith negotiation, and failing resolution within [30] days, through mediation in Arusha, Tanzania, before either party pursues formal proceedings. Subject to the foregoing, the courts of Tanzania shall have exclusive jurisdiction, save that we may bring proceedings for the recovery of unpaid amounts in any jurisdiction where you are resident or hold assets.
16.1 Entire agreement
These Terms, together with your booking confirmation and itinerary, constitute the entire agreement between you and Horn & Horizon Safaris and supersede any prior representations, whether written or oral, except in the case of fraud or misrepresentation.
16.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
16.3 Amendments to these Terms
We may update these Terms from time to time to reflect changes in our services, pricing practices, or legal requirements. The version applicable to your trip is the one in force at the date your booking is confirmed.
16.4 No waiver
Our failure to enforce any provision of these Terms shall not be construed as a waiver of that or any other provision.
